1. Who we are

Digsy is operated by Digsy ("we", "us"), based in South Africa. When you use Digsy you are contracting with Digsy. Contact: support@digsy.co.za.

2. The service

Digsy is an online marketplace connecting students looking for accommodation with landlords and accommodation providers across South Africa. Landlords can list properties (subject to our review and a yearly listing fee); students can browse listings and use AI-assisted recommendations. We are not a party to any lease agreement between students and landlords.

3. Acceptance

By accessing or continuing to use Digsy, you agree to these Terms. If you do not agree, do not use the service.

4. Eligibility and accounts

You must be at least 18, or have consent from a parent or guardian, and if you act for an organisation you must have authority to bind it. Keep your login details confidential; you are responsible for activity under your account. Provide accurate information and keep it up to date.

5. Acceptable use

You must not misuse Digsy, including by:

• using it for any unlawful purpose, or posting false, misleading or fraudulent listings;
• sending spam, scams or attempting to collect deposits for properties you do not control;
• infringing anyone's intellectual property, including uploading photos you have no right to use;
• interfering with security, introducing malware, probing systems, or scraping the site;
• reverse engineering, reselling, or circumventing technical limits of the service.

6. Listings and content

Landlords are responsible for the accuracy of their listings. You grant us a limited licence to host, display and process content you submit solely to provide the service. We may review, refuse, remove or restrict any listing or content at our discretion.

7. AI recommendations

Recommendations are generated automatically and may be inaccurate or incomplete. Always verify details, view the property and check the landlord before paying anything. You are responsible for what you type into the recommendation tool and how you use its results.

8. Intellectual property

Digsy owns Digsy and all related software, documentation, design and branding. We grant you a limited, non-exclusive, non-transferable right to use the service in line with these Terms.

9. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

The listing fee is a yearly subscription that renews automatically until cancelled. Payment, billing, tax, cancellation and refund terms are governed by Paddle's Buyer Terms. See also our Refund Policy.

10. Service level

We do not guarantee that Digsy will be uninterrupted, timely or error-free. To the fullest extent permitted by law, the service is provided "as is" without implied warranties of merchantability or fitness for a particular purpose.

11. Liability

To the extent permitted by law, we are not liable for indirect or consequential losses (including lost profits, data or goodwill), or for disputes between students and landlords. Our total liability is limited to the fees you paid us in the 12 months before the claim. Nothing limits liability for fraud, death or personal injury where the law does not allow it. You indemnify us against claims arising from your content, unlawful use or breach of these Terms.

12. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. When access ends, your listings are removed from public view and your data is handled as described in our Privacy Notice.

13. General

We are not responsible for delays caused by events beyond our reasonable control. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale. These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction. We may update these Terms and will post the new version here.
